These SMS Terms & Conditions (“Terms”) govern your use of the SMS messaging service provided by Empowered Services (“we,” “our,” or “us”), an Oregon-based agency serving individuals with intellectual and developmental disabilities (IDD). By opting in to receive SMS messages, you agree to these Terms, our Privacy Policy, and our SMS Privacy Policy.


1. Opt-In Consent

To receive SMS messages from Empowered Services, you must provide clear, one-to-one consent. You may opt in through:

  • A web form with an explicitly labeled checkbox

  • A paper form during service intake

  • Verbal agreement during enrollment with confirmation documentation

Your consent is specific to Empowered Services only and does not authorize third-party communication. Consent is not a condition of receiving care or services.


2. Types of Messages

Messages may include:

  • Appointment reminders

  • Service delivery updates

  • Safety or care-related notifications

  • Policy and schedule changes

  • Emergency or urgent alerts

You will not receive promotional or unrelated content through this service.


3. Message Frequency

You may receive up to 5 messages per day, depending on your service interactions. Message frequency may vary in the event of:

  • Urgent care or safety issues

  • Emergency weather or staffing changes

  • Required regulatory communications


4. Message and Data Rates

Standard message and data rates may apply. Charges are based on your mobile plan and carrier agreement. Empowered Services is not responsible for these charges.


5. How to Opt Out

You can cancel the SMS service at any time. To stop receiving messages:

  • Text STOP to any message

  • You will receive a confirmation that you’ve been unsubscribed

  • You will no longer receive SMS messages unless you re-enroll

7. Your Responsibilities

You agree to:

  • Provide a valid mobile number that belongs to you

  • Not misuse or abuse the SMS system (e.g., spam or false opt-ins)


8. Privacy and Security

Your privacy matters. We:

  • Only use your number for SMS delivery purposes

  • Do not sell or rent your phone number

  • Protect your information under HIPAA and Oregon laws

9. Disclaimer and Limitations

  • SMS delivery is dependent on your mobile network

  • We are not liable for delays or failures in message delivery

  • SMS services may not be available in all areas


10. Changes to These Terms

We may revise these Terms at any time. Any updates will be posted on our website and, if necessary, communicated via SMS. Continued use of our SMS services means you agree to the revised Terms.
